General terms and conditions

1. The terms and conditions regulate cases concerning the use of Pillovely.com online shop services. Pillovely.com online shop is available on http://www.pillovely.com.

2. Using Pillovely.com web page and/or ordering a product, means that the Customer accepts the following Terms and conditions of purchase of Pillovely.com online shop. Every Customer needs to read The terms and conditions of purchase of Pillovely.com online shop before ordering a product.

3. The owner of Pillovely.com online shop is Marboss Przemysław Balon Company, with its registered office in Chocznia, address: ulica Zawale 16, 34-123 Chocznia, NIP: 5512404140 , REGON (Polish Business Registry Number): 121304893. The owner of Pillovely.com online shop is called “the Seller” in the continuation of The terms and conditions of purchase of Pillovely.com online shop.

4. The online orders of the product are placed by the person called “the Customer”, who owns a Customer’s account in the Pillovely.com online shop.

5. All the intellectual rights, such as trademarks, symbols of the copyright on Pillovely.com web pages are properties of the Seller. Any use of the Pillovely.com web pages or their content, such as copying, distribution or storage of this content – in part or as a whole – in a different purpose than private or not commercial, is forbidden without receiving a former written permission of the seller.

Services

1. The owner of Pillovely.com online shop sells the products by the use of Pillovely.com online shop and provides the “Newsletter” service.

2. The order of the product in Pillovely.com online shop can be placed by the use of an interactive form, which enables the Customer to buy a chosen product.

3. The Seller provides free of charge services such as the Customer’s account, an interactive form and the Newsletter service.

4. The agreement providing electronic services based on having a Customer’s account in Pillovely.com online shop and The agreement providing the Newsletter service are concluded at the moment of the completion of a sign-up.

5. The agreement providing electronic services based on having a Customer’s account in Pillovely.com online shop is concluded as an open-ended contractual agreement.

Online services

1. A sign-up is voluntary. After the sign-up, an individual Customer’s account is created for every Customer.

2. The Customer can also buy products in Pillovely.com online shop without a sign-up. However, in this case, the Customer gives up the chance of having a Customer’s account in Pillovely.com online shop and the functionality of a Customer’s account providing services such as: remembering the Customer’s contact information (the customer’s address), following the progress of the delivery of the order and a faster way of buying in the future (a possibility to repeat the same order).

3. In order to sign-up, the Customer should fill in a sign-up form. In order to sign-up, the Customer needs: an e-mail address, account login and password.

4. During a sign-up, it is possible that the Customer’s contact information (the Customer’s address), which is needed to sending the order, will be required.

5. After a sign-up, the Customer receives an activation link which will be sent on the Customer’s e-mail address. Clicking on an activation link will finish the process of a sign-up. What is more, it is the confirmation that the personal data of the Customer in a sign-up form is true. After the completion of a sign-up, The agreement providing electronic services based on having a Customer’s account in Pillovely.com online shop is concluded.

6. The Customer can terminate the online agreement providing electronic services based on having a Customer’s account at every moment by sending such information as an e-mail on bok@pillovely.com or sending a letter on the address Ulica Zawale 16, 34-123 Chocznia.

7. The owner of Pillovely.com online shop can terminate the online agreement providing electronic services based on having a Customer’s account if the Customer has not been active in Pillovely.com online shop, which means the Customer has not ordered a product or has not logged into the Customer’s account for two year since the last logging.

8. The Customer is obliged to make use of Pillovely.com online shop in a legitimate way and with good manners considering the respect for personal interests, the copyright and the intellectual property of the owner of Pillovely.com online shop and third parties. The Customer is obliged to provide personal data which is true. The Customer is not allowed to provide any illegal information.

Orders

1. The Owner of the Pillovely.com online shop sells the products presented on the Pillovely.com online shop web pages.

2. The information about the products with their prices presented on the Pillovely.com online shop is not the offer according to art. 66 § 1 of the terms and conditions set forth in the Civil Code of the Polish law of April 23th, 1964 (Journal of Laws no. 16, item 93, 1964, as amended). The information about the products with their prices presented on the Pillovely.com online shop is only an invitation to conclude an agreement according to art. 71 of the terms and conditions set forth in the Civil Code of the Polish law.

3. The Pillovely.com online shop sells the products only in retail. In this case, the Customer cannot buy more than 20 items of the same product or similar products without contacting the Pillovely.com online shop in advance. The Owner of the Pillovely.com online shop has a right to refuse the execution of the order placed by the Customer, if the whole cost of the order is more than 1000 zloty in the next 30 days.

4. The Customers can order the products by the use of the Pillovely.com online shop web page. The orders can be placed 24 hours a day all year round. The orders, which are placed on Saturdays, Sundays or during secular celebrations or religious holidays, will be filled the next workday.

5. Placing an order is followed by choosing a product, filling in a personal data form, agreeing to process the personal data, accepting The terms and conditions of purchase of Pillovely.com online shop, choosing the conditions of the delivery, choosing a way of payment and confirming the order on the Pillovely.com online shop web page.

6. Placing an order of the product means submitting an offer of buying products by the Customer.

7. After placing an order the Seller sends the sign-up’s confirmation of the order on the Customer’s e-mail address, which was written in the personal data form.

8. The seller has the right to withdraw from a contract within 14 workdays from the date of concluding a contract according to § 5 ust. 12 lit. g. of the terms and conditions set forth in the Civil Code of the Polish law.

9. All the prices presented on the Pillovely.com online shop are presented in a Polish currency, which is zloty (zł.), or euro. All the prices in a Polish currency contain value added tax (VAT).

The delivery date and the costs of the delivery

1. The order is filled and the shipment are made by the Seller immediately after receiving the payment made by the Customer on the Pillovely.com online shop’s bank account (when our company receives the money for the product on the Pillovely.com online shop’s bank account, we will send our pillows to the Customer). The Customer is informed about filling the order by receiving an e-mail.

2. The average time of waiting for the order is described in The delivery date division on the main page of the Pillovely.com online shop. The Customer is also informed about the average time of waiting for the order within the process of ordering the products. Everything depends on the option the Customer chooses.

3. In the random situations connected with the lack of the product in the warehouses of the Seller, the Owner of the Pillovely.com online shop is obliged to inform the Customer about the delay by sending an e-mail or making phone calls to the Customer. In cases when natural disasters or situations that the Seller has no impact on happen, the average time of waiting for the order can be longer than usual. The Customer will be informed about any changes of the date of receiving the products. In this kind of situations, the Customer has a right to withdraw from a contract.

4. In the Pillovely.com online shop the shipment is made by GLS Poland company and the bought products are delivered to the address given by the Customer.

5. The costs of the delivery are located in divisions on the main page of the Pillovely.com online shop.

6. The Pillovely.com online shop issues VAT invoice for goods purchased.

7. In case of not delivering the parcel by the GLS Poland to the Customer because of the Customer’s fault, the Pillovely.com online shop will make the shipment of the product to the Customer one more time on condition that the costs of the delivery the parcel to the Customer will be paid by the Customer. When the parcel has not been picked up by the Customer for three times , the Pillovely.com online shop has a right to withdraw from a contract because of the Customer who defaults on the conditions of the contract. In this case, the owner of the Pillovely.com online shop has also a right to terminate the online agreement providing electronic services (the shutdown of the Customer’s account). In case of withdraw from a contract, the Pillovely.com online shop will give back the money for the product to the Customer, but the money is going to be lower, because of the costs of the delivery the Pillovely.com online shop had to pay.

8. In case the parcel will not be picked up by the Customer, the costs of returning the parcel to the Pillovely.com warehouse’s address will be paid by the Customer.

9. The Customer is obliged to check if the wrapping of the parcel is damaged or shows signs of tampering at the moment of the delivery and at the presence of the courier from the courier services. In case of external damages of the parcel, the Customer is obliged to draw up a protocol with the courier from the courier services. What is more, the Customer is obliged to inform the Pillovely.com online shop about this situation by sending an e-mail to bok@pillovely.com and writing “Damage during the transport” as the topic of an e-mail.

10. The self-pickup of the product bought by the Customer from the Pillovely.com online shop is only possible after the previous agreeing the date of the self-pickup with the Owner of Pillovely.com online shop. The self-pickup of the product bought by the Customer from the Pillovely.com online shop can only be possible in the seat of the Pillovely.com company at the address:

Payment and the payment date

1. The Seller offers following ways of payment: (1) money transfer on the bank account of the Pillovely.com, (2) by cash on delivery the parcel – but only in the territory of Poland, (3) by the PayPal service, (4) by the Przelewy 24 service. In all cases, the Customer needs to follow the terms and conditions of these mentioned payment services.

3. In case of the payment by money transfer on the bank account of the Pillovely.com, the delivery date of the order starts from the day when the owner of the Pillovely.com online shop receives the money for the order on the bank account.

4. In case of the payment by cash on delivery the parcel, our company sends the product to the Customer after we check that our Customer’s contact information (the Customer’s address) is correct.

Withdrawing from a contract

1. The Customer, who has concluded The contract or The agreement providing electronic services based on having a customer’s account in Pillovely.com online shop, can withdraw from a contract without giving any explanation. The Customer is allowed to do this by writing and sending a declaration about withdrawing from a contract (e.g by letter, or e-mail) within 14 days from the date of receiving the parcel. If the Customer wants to meet the deadline, the declaration needs to be sent before the deadline.

2. Withdrawing from a contract is followed by writing and sending a declaration about withdrawing from a contract by the Customer. The declaration can be sent as a form available in the Complaints division or as a form which is added to the confirmation of the order sent as an e-mail. The Customer should send the declaration as a letter to Pillovely.com ul. Zawale 16, 34-123 Chocznia or as an e-mail to bok@pillovely.com.

3. In case of sending back the product to the Pillovely.com online shop, the Customer needs to contact with our Customer services by sending an e-mail to bok@pillovely.com. The content of an e-mail should have the number of the order and some information about the reason (the reason is not required) of sending back the bought product. When the Customer sends back the bought product to the Pillovely.com online shop, this parcel should also have a filled in form available in the Complaints division. A correctly filled in form or a different way of sending all the information needed to identifying the order and the Customer, is an essential condition needed to withdrawing from a contract, sending back the bought product and returning the worth of the bought product by transferring the money to the customer’s bank account by the Pillovely.com online shop. The Owner of the pillovely.com online shop is not responsible for not providing all the required information needed to identifying the order and the Customer.

4. If a product was bought in the Pillovely.com online shop, the Customer should give the product back within 14 days from the date of withdrawing from a contract.

5. In case of withdrawing from a contract by the Customer, the Pillovely.com online shop is obliged to give back the money for the bought products with the costs of sending the product to the Customer, in the same way the payment was made by the Customer within 14 days. In case of the payment by cash on delivery the parcel by the Customer, but only in the territory of Poland, Pillovely.com online shop gives back the costs to the Customer by transferring the money to the customer’s bank account. The Customer needs just to send an e-mail to bok@pillovely.com with the number of the bank account of the Customer and some information about the reason of sending back the product (the reason is not required).

6. The Pillovely.com online shop is not obliged to give back the money of the costs of sending back the product to the Pillovely.com company, after the product was bought in the Pillovely.com online shop, if the costs of sending back the product to the Pillovely.com company were higher than the cost of the cheapest way of delivering the product to the Customer. The cheapest ways of delivering the product are offered by the Pillovely.com online shop.

7. When the Customer makes the decision about withdrawing from a contract, the Customer is responsible for sending back the product. Sending back the product is only possible when the product is in an uptapped condition – unused, originally packed with the full content.

8. In case the product is incomplete or damaged, the Owner of the Pillovely.com online shop is entitled to refuse to take back the product which was sent back by the Customer.

9. In case the Customer uses the right to withdraw from a contract, the Customer pays the costs of sending back the product unless it was indicated before that in this situation the costs would be paid by the pillovely.com online shop.

10. The Owner of the pillovely.com online shop is not responsible for not delivering the product to the Customer when the Customer’s personal data with the Customer’s address is not correctly provided by the Customer. In this case, the Seller is obliged to inform the Customer about making the attempt to deliver the product to the Customer by sending an e-mail with this kind of information.

11. The Seller does not take back the parcels which are sent back as COD – paying by cash on delivery the parcel.

The protection of personal data

The rights and obligations of the Customer and the Seller

1. The Owner of the Pillovely.com online shop will do all his best to make the Pillovely.com online shop and all services, which the shop provides, work without any problems.

2. The Owner of the Pillovely.com online shop is entitled to tamper with the technological structure of the Customer’s account in order to get to the bottom of any irregularities connected with functioning of the Pillovely.com online shop’s services.

3. The Owner of the Pillovely.com online shop is entitled to a temporary, but not longer than 24-hour, cutting off some functions of the Pillovely.com online shop in order to improve, add some services or to do the maintenance. Every cutting off is preceded by informing the logged Customers about this situation.

4. The Customer is obligated to keep confidential and protect the account login and the password to the Customer’s account in order to prevent any unauthorized person from accessing to the Customer’s account.

Final resolutions

1. In any unsettled cases by The terms and conditions of purchase of Pillovely.com online shop, the Polish law applies.

2. In case of any issues connected with fulfilling the agreement with Pillovely.com online shop on the bases of The terms and conditions of purchase of Pillovely.com online shop, both the Customer and Owner of the Pillovely.com online shop are obliged to find an amicable solution.

3. In case of not being able to find an amicable solution, the court which always deals with such cases, is the court proper to the seat of the Owner of the Pillovely.com online shop.

4. The Owner of the Pillovely.com online shop is entitled to change The terms and conditions of purchase of Pillovely.com online shop. The Customers will be informed about any changes of The terms and conditions of purchase of Pillovely.com online shop on the main page of the Pillovely.com online shop. The changes of The terms and conditions of purchase of Pillovely.com online shop are intended to apply from the period indicated by Pillovely.com online shop, which is not shorter than 7 days from the date of the information about the changes of The terms and conditions of purchase of Pillovely.com online shop on the main page of the Pillovely.com online shop.
